CAA wins Emirates case

A decision by the UK Supreme Court to refuse Emirates Airlines permission to appeal against a ruling on passenger compensation for missed connections outside the EU was welcomed by the Civil Aviation Authority (CAA) last week.

The body said the decision meant Emirates passengers who miss connections can now be compensated €600 and claims can also be made retrospectively up to six years.

The Supreme Court said Emirates’ appeal did not raise an arguable point of law because the Court of Justice of the European Union had already given a clear answer.

The CAA said the ruling confirmed the CAA's interpretation of the relevant regulation, on which it began enforcement action against five airlines, including Emirates, in spring last year.

The carriers had failed to compensate passengers who had suffered a long delay as a result of a missed connection outside the EU. Four of the airlines moved into compliance following the enforcement action but Emirates sought leave to appeal.

The CAA said it would now progress its enforcement action against Emirates “to ensure the airline complies with the law, requiring it to amend its policies and practices and to pay claims it had incorrectly refused previously”.
